1. AviLoft and these terms
AviLoft provides digital loft-management, documentation and marketplace tools. The operator is AviLoft, Belgium. Questions about these terms can be sent to the support address shown below.
By creating an account or using a customer workspace, you agree to these terms. Marketplace sellers must also accept the marketplace fee terms when publishing a listing.
2. Accounts and customer approval
You must provide accurate information, keep your login details secure and be at least 18 years old or otherwise legally able to enter into these terms.
AviLoft may review, approve, refuse, suspend or close accounts where necessary to protect customers, the platform or applicable law.
3. Plans and service availability
Plan features, usage limits and prices are shown on the website or in the applicable commercial offer. The Free plan currently permits up to 15 registered pigeons.
Paid subscriptions are processed by Stripe and renew automatically for the selected monthly or annual billing period until cancelled. Checkout shows the recurring amount and applicable taxes before purchase. Customers can manage billing details, invoices and cancellation through the billing portal. Cancellation takes effect at the end of the current paid period unless mandatory law or the applicable offer requires otherwise; statutory consumer, withdrawal and refund rights remain unaffected.
AviLoft may improve or change features. Material changes affecting a paid subscription will be communicated in advance where reasonably possible.
4. Marketplace role
AviLoft Marketplace provides presentation, enquiry, offer and reservation tools. Unless AviLoft expressly states otherwise, the sale agreement is between the seller and buyer. AviLoft is not the owner, breeder, transporter or veterinary guarantor of a listed pigeon.
An advertised listing is an invitation to make an offer. An offer becomes a reservation when accepted by the seller. Seller and buyer remain responsible for agreeing payment, transfer, transport, export, welfare and any legally required documents.
5. Seller responsibilities
The seller must own or be authorised to sell the pigeon and must provide accurate identity, pedigree, health, performance, media, price and contact information. Material defects, restrictions and uncertainty must be disclosed.
The seller must comply with animal-welfare, veterinary, transport, tax, consumer and export rules that apply to the sale.
6. Marketplace success commission — 7.5%
When a pigeon is sold to a buyer introduced through AviLoft Marketplace, the seller owes AviLoft a success commission of 7.5% of the final agreed sale price, excluding transport and separately itemised taxes. VAT may be added where legally applicable.
The agreed percentage is recorded when the listing is published. It also applies when the sale is concluded outside the platform with a buyer who first contacted or identified the pigeon through AviLoft during the listing or within 90 days after it ended.
The seller must mark the listing as sold and declare the true final sale price within seven days. AviLoft may issue an invoice for the commission. The commission is due even when buyer and seller arrange payment directly. If a documented sale is cancelled and no payment or transfer occurs, the seller may request a correction.
7. Offers, sales and sold listings
Users must act honestly and may not submit false offers, manipulate prices, conceal a completed sale or use AviLoft to avoid an agreed commission.
Sold listings may remain visible for provenance and market transparency, clearly marked as sold and displayed after available listings.
8. Media, documents and intellectual property
You retain ownership of content you upload. You grant AviLoft the permission needed to store, process, display and reproduce that content for the service, Marketplace and customer-generated documents.
You may only upload material you are entitled to use. AviLoft branding, software and templates remain protected intellectual property.
9. Acceptable use and suspension
You may not misuse the service, attempt unauthorised access, upload malicious or unlawful material, infringe another person's rights or interfere with platform operation.
AviLoft may remove content or restrict access where reasonably necessary for security, non-payment, misleading listings, legal compliance or a serious breach of these terms.
10. Liability
AviLoft uses reasonable care to provide a secure and reliable service, but customer data, pedigrees, race results and listings depend on information supplied by users and third parties. Users must verify information before breeding, purchasing, selling or transporting a pigeon.
Nothing in these terms excludes liability that cannot legally be excluded. Subject to mandatory law, AviLoft is not liable for indirect loss or for disputes, transport, health, fertility, performance or payment between buyer and seller.
11. Law, changes and contact
These terms are governed by Belgian law, without limiting mandatory consumer rights. Courts with jurisdiction under applicable law may hear disputes.
AviLoft may update these terms. The effective date and version will be shown on this page. Material changes will be communicated where required.
